Alberthe Bernier, Counsel to the Firm, practices in Riker Danzig’s Estate Planning and Elder Law Groups.  She concentrates her practice in the areas of Elder Law, Medicaid planning, trust and estate planning, estate administration, special needs planning, and contested and uncontested guardianship proceedings.

As an elder law attorney, Alberthe assists seniors with a variety of legal issues, such as Medicaid planning, asset protection planning and long-term care planning.  This includes assistance with counseling clients on Medicaid approved asset transfers, establishing and maintaining eligibility for Medicaid, navigating the nursing home and/or assisted living facility admissions process, and obtaining homecare services for the elderly.  Additionally, Alberthe regularly files and defends contested and uncontested guardianship proceedings involving the elderly and disabled population. Alberthe also assists court appointed guardians with satisfying their annual accounting and reporting requirements.

As an estate planning and administration attorney, Alberthe assists clients with estate and tax planning and asset preservation.  She assists clients with crafting customized estate plans to meet the individual needs of her clients, such as the preparation of Wills, Asset Protection Trusts and Advance Directives.  

In connection with special needs planning, Alberthe assists individuals with disabilities and their families with appropriate estate planning, such as the drafting of special needs trusts, filing for guardianship proceedings for individuals with special needs, providing personal injury settlement consulting, and establishing and maintaining eligibility for government benefits. Alberthe also assists individuals and corporate fiduciaries with judicial and administrative accountings, and offers counseling in the administration of special needs trusts. 

Alberthe is a member of the New York State Bar Association’s Elder Law and Trusts & Estates Sections.

Alberthe received her J.D. degree from St. John’s University School of Law in 2008 and earned her B.S. degree, summa cum laude, in Criminal Justice from St. John’s University in 2004.  Alberthe is admitted to practice in New York.
