John M. Loalbo is a partner in the Tax and Trusts & Estates Department and chairs the Firm’s Probate Litigation Group.  John focuses on all aspects of wills and trusts and estate matters with an emphasis on probate litigation, on a national basis.  John offers a unique skill set with almost three decades of dual expertise in tax, trusts and estates and litigation. This combination of extensive litigation experience with tax, trusts and estates knowledge proves invaluable to achieving a client’s objectives, whether in probate litigation or estate planning.

Probate litigation is a unique and growing area of the law. With his probate litigation experience, John is familiar with the unique rules, procedures and substantive law involved in probate litigation. John, a litigator with a trusts and estates and tax law background, including an LL.M. in Taxation, has the advantage in the courtroom of being able to draw on his years of experience counseling clients regarding sophisticated estate planning and estate administration, including related tax ramifications. This dual background enables John to spot the deficiencies in an adversary’s case and use it to his client’s advantage. For example, during a trial John knows the precise questions to ask and the appropriate answers to those questions, allowing him to create a basis on which to discredit an adversary’s expert testimony or even disqualify the expert from testifying.

John’s probate litigation experience also informs the estate planning choices offered to the firm’s clients. John’s experience allows him to anticipate commonly litigated issues and recommend estate plan features that reduce the likelihood that these plans later end up in litigation.

John received an LL.M. from Boston University School of Law, where he was a member of the Boston University Journal of Tax Law. He received his J.D. degree from Gonzaga University School of Law, where he was a member of the Canadian-American Law Review, and earned his B.A. degree from Seton Hall University.

Prior to joining Riker Danzig, John was a partner at Weiner Lesniak LLP in their Trusts & Estates group.  John has authored several publications in the trusts and estates area.
