Richard J. L. Lomuscio is a partner in Riker Danzig’s Commercial Litigation and Securities Litigation Practices, resident in the Firm’s New York office. Richard is an experienced litigator, regularly handling multi-million dollar commercial and regulatory matters for a variety of clients, including complex securities class actions and disputes relating to complex financial instruments, mortgage securitizations, and corporate governance. 

He represents clients in civil and criminal matters before FINRA, the Securities and Exchange Commission, the Department of Justice, and the Federal Energy Regulatory Commission. He has also represented insurance and banking companies in disputes with former employees, including obtaining a preliminary injunction for a mortgage company and a temporary restraining order for a leading bond fund in two separate employee poaching cases. 

In one high profile case, Richard successfully argued in the Second Circuit for the reinstatement of claims brought by an international hedge fund.  Earlier in his career, he obtained dismissal of claims against an international financial services firm facing claims of wrongdoing related to the collapse of Enron in a FINRA arbitration and defended dozens of complex securities class actions arising from the “dot.com” bubble, including oversight of briefing and extensive eDiscovery. 

His practice extends into the technology industry, where he represents clients in all facets of regulatory and complex litigation matters. An international electronics firm relied on Richard to argue motions precluding the disclosure of confidential documents in a false advertising action, which resulted in Richard ultimately securing a favorable settlement for the client.  More recently, Richard has advised fintech companies on regulatory issues involving cryptocurrency. 

Richard has also been active in pro bono work. He has assisted victims of domestic violence in obtaining orders of protection, served as a Special District Attorney in Kings County, New York to argue for affirmance of a conviction, and volunteered at the NYC Bar’s Monday Night Law Program. 

Richard is a frequent writer on litigation and securities topics, and is often quoted regarding trends in these areas. Prior to joining Riker Danzig, he was Counsel with a large, national firm, and previously served as Vice President and Associate General Counsel at Goldman, Sachs & Co., and a Director at UBS Investment Bank.  Richard began his career at Sullivan & Cromwell LLP.
