Adam J. McInerney

Adam J. McInerney is a Partner in the Firm’s Labor and Employment Group.

His practice is concentrated primarily in the representation of management in employment-related litigation in state and federal courts and before the Equal Employment Opportunity Commission and the New Jersey Division of Civil Rights.

Adam has successfully defended lawsuits asserting claims of discrimination, harassment, retaliation, whistleblowing, violations of ERISA, violations of COBRA, violations of state and federal wage and hour statutes, breach of contract, misappropriation of trade secrets, unfair competition, violation of restrictive covenants, and class actions.

In addition to his litigation practice, Adam regularly counsels clients on various types of employment matters, including the creation and administration of company policies and handbooks, separation agreements, executive employment contracts, discipline, terminations and reductions in force, investigations, drug testing, WARN Act compliance, wage and hour compliance, and family and medical leave issues. In both his litigation and counseling practice, Adam provides services to clients ranging from Fortune 100 companies to smaller, closely held businesses.

Adam is also experienced in employee benefits and executive compensation, with a particular emphasis on ERISA compliance and tax qualification issues. He counsels clients in connection with plan drafting, implementation and termination issues, fiduciary liability, administration and operation of pension and welfare benefit plans and employee communications.

In the area of executive compensation, he advises clients regarding Code Section 409A compliance; he has assisted in the implementation and operation of various equity-based deferred compensation plans, incentive programs, option plans, severance arrangements, and supplemental benefit plans; and he has counseled on financing techniques designed to meet employer obligations while avoiding tax pitfalls.

Before becoming an attorney and while in law school, Adam worked in the securities industry.

Adam is a former Law Clerk for the Honorable Donald G. Collester, Jr., Superior Court of New Jersey, Appellate Division.
