Welcome to the Appellate Law Blog!

The Appellate Law Blog is Riker Danzig’s new resource for analysis and commentary on appellate practice.  Our coverage will focus on the New Jersey Appellate Division, the New Jersey Supreme Court, the New York Appellate Division and Court of Appeals, and the United States Courts of Appeals for the Second and Third Circuits. We will also address United States Supreme Court decisions of particular significance to those courts or our clients.

Decisions from these courts shape the legal landscape in which our clients operate.  The reasoning in those opinions, the trends they reflect, and the changes they bring to the law warrant closer attention than they often receive.  This blog is intended to provide that attention.

Readers can expect two broad categories of coverage:

  • Decisions and developments.  Analyses of significant rulings, rule changes, and other newsworthy developments, with an emphasis on the implications for litigants.
  • Practical guidance.  Discussions of practical lessons and nuances in appellate practice such as appellate procedure, the preservation of error, standards of review, record development, and oral argument, all informed by our team’s experience as advocates and as former jurists.

Our intended readers include trial and in-house counsel evaluating post-judgment options, organizations and industry groups interested in amicus curiae participation, and business stakeholders curious about appellate decisions affecting their sectors.

The appellate practice demands precision, a mastery of the law, and the ability to distill complex issues into clear propositions that a panel of judges or justices will accept.  The Appellate Law Blog is for readers who share an interest in that work, and we are pleased to bring that discussion to you.
