Matt Karmel Quoted Re Environmental Justice in ERIS Originals Blog
Environmental Associate Matthew A. Karmel was quoted extensively in the ERIS Environmental Due Diligence Blog Post entitled “New Jersey’s EJ Law Signals Wave of Policy Changes That Will Impact Our Industry.” The post discussed New Jersey’s landmark Environmental Justice legislation and the Biden agenda. Matt addressed the disproportionate impact analysis, which is the basis of New Jersey’s environmental justice law. Matt said, “NJDEP seems to be moving toward creating a bright-line test as to when a facility contributes to a disproportionate impact.” Matt identified several critical considerations that will be key to the outcome of the disproportionate impact analysis: “What are the impacts that get measured? What are the data sets used to measure these impacts? How much flexibility will permittees and communities have to contextualize the impacts?”
