NJDEP Restricts VOC Content in Consumer Products

On November 6, 1995, NJDEP published new regulations under the Air Pollution Control Act establishing limits on the amount of volatile organic compounds (VOCs) that may be contained in certain specified consumer products. The products regulated under these new restrictions include hair spray, deodorants and antiperspirants, air fresheners, various cleaners and insecticides. The new regulations apply to all persons who manufacture, distribute or supply the specified products, which are manufactured after April 30, 1996 and sold for use in New Jersey.

The manufacturers of these products also are required to submit registration reports, label their products as to the date of production, and keep records of their compliance with the VOC-content limitations. Failure to comply with these new regulations may result in civil or criminal penalties. Thus, manufacturers, distributors and suppliers of consumer products in New Jersey should evaluate their products for compliance with the new limitations on VOC content and implement any necessary changes prior to April 30, 1996.
