This is for REAL: NJDEP published its proposed Resilient Environment and Landscapes ("REAL") rule in the August 5th New Jersey Register as part of its Protecting Against Climate Threats ("NJPACT") initiative. The public has until November 3rd to submit comments on the proposal and the new standards are anticipated to become REAL in the fall of 2025. The rule increases the Coastal Flood Hazard Area by five feet, but the REAL reach of the rule goes far beyond the Coastal Zone. There are REAL limits to development in wetlands and proposed stormwater management revisions that may limit buildable space and increase development costs. Join us as our experienced attorneys discuss the features of the rule proposal and how your projects may be impacted.
