Permit Extension Act Likely to Expire

October 30, 2016

The Permit Extension Act, originally enacted in 1992, is due to expire on December 13, 1996, with no indication that either the Governor or the Legislature is moving to extend it. The Permit Extension Act was designed to respond to New Jersey's "state of economic emergency" by extending the duration of certain governmental approvals and permits that otherwise would have expired between January 1, 1989 and December 31, 1996. Most of these permits were related to construction. The permits that were extended by the Permit Extension Act are now likely to expire on December 31, 1996. As a result, we expect that many developers and builders will rush to construct their projects before that date.
