Riker Danzig Bankruptcy & Corporate Restructuring counsel Daniel A. Bloom authored “Key Considerations for Attorneys Representing Landlords Dealing with a Commercial Tenant's Bankruptcy” which was published in the January 2025 American Bankruptcy Institute Journal. The article provides an overview of many issues that commercial landlords face when a tenant files for bankruptcy, including the automatic stay, assumption and rejection of leases, pre-and post-petition rent claims, real estate taxes, and exceptions to certain rules, among other considerations that Dan addresses. Dan notes that, “attorneys must obtain familiarity with jurisdiction-specific precedent and practice” when representing the interests of landlords in tenant bankruptcies.
