Counsel Rudy Randazzo Quoted Re Farmland Assessment Appeal

Riker Danzig Counsel Rudy A. Randazzo was quoted extensively in the May 4, 2020 Law360 article, “Alcatel-Lucent Aims to Revive Farmland Assessment Appeal,” regarding our appellate court representation of client Nokia (Alcatel-Lucent) in a complex property tax matter.  Nokia is seeking a farmland assessment for a wooded 53-acre portion of its Berkeley Heights, New Jersey headquarters.  Arguing for Nokia on May 4 before the New Jersey Superior Court Appellate Division, Rudy stated that since the property does not produce income, the municipal tax assessor’s request for records is not applicable, and the issue is really one of a farmland assessment and a “constitutional imperative to preserve countryside and farmland for all residents.”

Rudy also noted that “there is no equitable basis to deny an assessment,” because there was no substantive error on behalf of the property owner.  He stressed to the court that the key issue in the case is not the valuation of property, but rather “a determination of whether or not the [property meets] the requirements of the Farmland Assessment Act.”
