Environmental Associate Jordan Asch Speaks on Mitigating Delays Due to Offsite Access

On February 13, 2024, Riker Danzig Environmental Associate Jordan Asch was a presenter at the LSRPA continuing education February Virtual Regulatory Roundtable, “Mitigating Delays Due to Offsite Access.” Delays due to property access issues for the purposes of remedial investigation and action can be significant, untimely, and costly. For the Person Responsible for Conducting Remediation (“PRCR”) and the Licensed Site Remediation Professional (“LSRP”) who oversees the remediation on their behalf, it makes meeting applicable remedial time frames much more challenging. Often, this results in the need for an extension of a timeframe. While certified letters are indeed required, offsite access can be a tricky topic that is best addressed via multiple lines of communication.

Jordan, along with LSRP Alex Saltzman of French & Parrello Associates and William Lindner of New Jersey Natural Gas, provided an overview of the regulatory requirements for public notification and obtaining site access as well as tips on how to avoid delays, legal perspective and case studies for examples. The presentation was followed by an interactive open forum roundtable discussion moderated by Ken Haduch, LSRP, ERM.
