Partner Stuart Lederman commented in a New Jersey Law Journal article, “11 Years Later, Still No Traction on Lawmaker’s Anti-‘Kelo’ Bill,” which discussed the use of eminent domain in private redevelopment. Proposed legislation to curb the use of eminent domain in light of the 2005 United States Supreme Court decision in Kelo v. City of New London has been introduced several times over the past 10 years but has not gained any traction. Stuart commented on the lack of significant impact the 2005 Kelo decision has had in New Jersey and noted the the use of eminent domain is an important tool for government to promote redevelopment. “It would be wonderful if private redevelopment could occur in some of the urban areas without eminent domain.
