Riker Danzig Associate Quoted Regarding Account Wagering

October 31, 2016

Riker Danzig associate Kellen Murphy was quoted by Law360 in its article covering a case before New Jersey’s Appellate Division over account wagering.  Riker Danzig represents New Jersey Account Wagering, LLC, which contends that the New Jersey Sports and Exposition Authority’s 2012 contract with Darby Development, LLC to manage New Jersey’s account wagering system is in violation of the state’s Off-Track and Account Wagering Act because Darby Development has been retained as a non-agent independent contractor.  New Jersey Account Wagering has requested that an amendment be made to the contract.  At oral argument before the Appellate Division on November 3rd, Kellen argued that requiring agent status for Darby would guarantee sufficient controls and responsibility over the company.

“It’s a very narrow issue which would not disturb the account wagering system and would not disturb Darby,” Kellen explained to the court in requesting that it require the agreement be amended.

Riker Danzig partner John Pellecchia and associate Cristin Boyle are also working with Kellen in representing New Jersey Account Wagering’s interests in this case, In the Matter of the New Jersey Racing Commission Approving New Jersey Sports & Exposition Authority Application and I/M/O Order of the New Jersey Racing Commission Approving the New Jersey Sports & Exposition Authority’s Continued Use of Darby Development LLC.
