2 Cases Highlight Superpriority Lien Risks For Lenders

Riker Danzig Co-Managing Partner Michael R. O’Donnell and Litigation associate Michael Crowley co-authored an article for Law360 discussing two recent decisions that affirm the need for lenders to be diligent in paying off liens for property taxes and homeowner association dues before sales occur. The article addresses issues raised in Wells Fargo Bank NA as Trustee for Carrington Mortgage Loan Trust, Series 2006-NC3 Asset-Backed Pass-Through Certificates v. Budram in New York's Appellate Division, Third Department, and in Wells Fargo Bank NA v. Mahogany Meadows Ave in the U.S. Court of Appeals for the Ninth Circuit.
