There has been significant progress for companion bills S-1307/A-2478 first reported in the July 2000 issue of UPDATE. The bills provide that municipal remediation ordinances would not apply to property being investigated or remediated under NJDEP oversight so long as a "No Further Action Letter" would be issued by the agency prior to and as a condition of any development approval by the municipality. A-2478 passed the Assembly in March and was referred to the Senate Environment Committee. Both bills were amended by the Senate Environment Committee to limit their application to those properties being remediated for historic pesticide contamination, and had their second readings in the full Senate on May 24, 2001.
