Schellhorn, both of whom practice in the Firm’s Bankruptcy & Reorganization Group, co-authored “A Fish Out of Water: Streamlining Plan Confirmation for Individual Chapter 11,” which was highlighted on the cover of the June 2014 American Bankruptcy Institute Journal. The article analyzes section 105(d)(2)(B)(vi) of the Bankruptcy Code and discusses instances where this provision has been utilized to expedite the confirmation process in individual chapter 11 cases. The article also highlights jurisdictions that have adopted local rules and/or combined plan and disclosure statement forms, including the Bankruptcy Court for the District of New Jersey.
