Riker Danzig succeeded in having a New Jersey Spill Act claim dismissed against client Rio Tinto Minerals, a multinational metals and mining company, in NL Industries v. Old Bridge Township, et al. on June 30th. The U.S. Army Corps of Engineers and several companies, including Rio Tinto Minerals, had urged a New Jersey federal court to dismiss the suit brought by NL Industries over $79 million in Superfund cleanup costs. Rio Tinto Minerals was named in NL Industries’ complaint, alleging improper disposal of waste materials from a lead smelting facility operated by NL Industries. Still to be considered are claims under federal environmental law. Environmental Partner Jeffrey Wagenbach and Counsel Alexa Richman- La Londe represent Rio Tinto Minerals in the Superfund suit.
