Riker Danzig Counsel Robert P. Vacchiano of the Firm’s Cybersecurity & Data Privacy Practice authored “Cyber Insurance Update: Recent Decisions Addressing Coverage for Cyber Losses,” published in the November 27, 2024 issue of the New Jersey Law Journal. With several significant coverage decisions issued in 2024, the article first covers the ramifications of the New Jersey Appellate Division’s Merck decision, where the court held that an exclusion for hostile/warlike action did not apply to bar coverage for losses attributable to a NotPetya malware attack despite the insurers’ contention that the attack was the work of a nation-state actor. Robert also covers decisions in Illinois’ Supreme Court and Appellate Court that will serve as guidance for other jurisdictions concerning coverage under that state’s unique Biometric Information Privacy Act (“BIPA”).
