ALM’s “Litigation Daily: Litigator of the Week” column gave a “shout out” to Firm Co-Chairman Brian E. O’Donnell and his team for their win for client BSH Home Appliances in California federal court, securing a motion to dismiss against a putative consumer class action. Plaintiffs’ complaint sought damages based upon counts sounding in breach of implied warranty, breach of express warranty and breach of contract under Florida and Minnesota law, as well as claims under Minnesota’s Consumer Fraud Act, Uniform Deceptive Trade Practices Act and Unlawful Trade Practices Act.
The ALM story commended Brian and his team of Maura Smith and Caroline Brizzolara for “knocking out a consumer class action,” since the suit failed to allege an injury in fact sufficient to confer Article III standing.
