Riker Danzig Insurance Group Secures $1.3 Million Judgment for Nationwide

Riker Danzig’s Insurance Group obtained a judgment in excess of $1.3 million on behalf of our client Nationwide Mutual Insurance Company against Wesco Insurance Company.  The dispute centered on whether a commercial general liability policy or business auto policy should respond to the contamination of a cheese processing plant in upstate New York caused by the insured’s delivery of milk contaminated from metal tailings in the tanker delivery truck.  When Wesco denied coverage of the insured, Nationwide defended and settled the case on behalf of the insured, and then pursued Wesco for reimbursement in the U.S. District Court for the Southern District of New York.  Judge Alison Nathan granted our summary judgment motion on behalf of Nationwide, ruling that Wesco must reimburse Nationwide for the settlement, defense costs, and prejudgment interest.  Co-Managing Partner Lance J.
